A Fulton County grand jury has indicted Kroy "KJ" Biermann Jr. on seven felony counts stemming from an alleged sexual assault at a suburban Atlanta gym. The charges include aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery.
Prosecutors say the alleged encounter occurred inside a family changing area at a Life Time Fitness location in Alpharetta. The alleged victim is a 15 year old girl whose identity is being withheld because she is a minor and an alleged victim of sexual assault.
Biermann remains in youth detention in Atlanta as his attorneys press for release and a transfer of the case into juvenile court. He has denied the allegations through his lawyer Jason Sheffield, who says Biermann is innocent and seeks handling of the matter in juvenile court.
Legal Fight Evidence And Family Response
The indictment expands earlier magistrate charges and follows an investigation that included a sexual assault exam and a review of gym surveillance footage. Police reports say the pair entered the family locker room and remained inside for about thirty minutes before the girl left toward the lobby.
Defense filings and statements contend that forensic testing of the sexual assault kit found no male DNA and that Biermann voluntarily took and passed a polygraph, according to the defense. Sheffield has also criticized the grand jury process for not allowing Biermann to present his side before indictment.
Georgia law gives superior courts original jurisdiction over certain serious offenses committed by defendants between 13 and 17. That framework means a judge will decide whether the case stays in superior court or is transferred to juvenile court after considering the seriousness of the alleged conduct and prospects for rehabilitation.
Kim Zolciak, Biermann’s mother and a reality television alum, has publicly defended her son and called the allegations reckless. Prosecutors and defense lawyers will contest the significance and admissibility of forensic and testimonial evidence as the matter proceeds in Fulton County Superior Court.
